Izmeklētājs ir izmeklēšanas iestādes amatpersona, kura ar izmeklēšanas iestādes vadītāja rīkojumu pilnvarota izdarīt izmeklēšanu kriminālprocesā.
Tēmas aktualitāti atspoguļo apstāklis, ka līdz ar Kriminālprocesa likuma pieņemšanu, izmeklētāja pilnvaras, veicot izmeklēšanu kriminālprocesā, nav pietiekami izpētītas Latvijas Republikas juridiskajā literatūrā. Izmeklētāja pienākumi ir noteikti likumā “Par policiju”, Kriminālprocesa likumā, ka arī citos likumos un normatīvos aktos.
Izmeklētāja pilnvaras vēsturiski ir sadalītas vairākos attīstības posmos. Izmeklētāja pilnvaras ar laiku attīstījās un paplašinājās. Izmeklētāja pilnvarās ietilpst noziedzīgu nodarījumu konstatēšana, noziedzīgu nodarījuma apstākļu noskaidrošana, ka arī vainīgo personu noskaidrošana.
Diplomdarbs sastāv no ievada, trijām nodaļām, kopsavilkuma un pielikumiem. Kriminālprocesa likumā izmeklētāja pilnvarām ir liela nozīme, jo izmeklēšana ir pirmais solis, kas veido sprieduma pamatu.
Apskatot izmeklētāja pilnvaras, autors savā diplomdarbā izmantoja likumus un normatīvos aktus, kuros bija noteiktas izmeklētāja pilnvaras. The investigator – it is a position in investigatory institution which has the right at the head disposal to conduct investigation within the bounds of criminal proceedings.
The subject of the paper reflects the fact that with the new criminal legislation the power to carry out investigation often is not studied by jurisdiction of the Republic of Latvia. The powers of the inspector are defined in the law "About police", criminal law and in other laws and resolutions.
The powers of the inspector are historically divided into some stages and they extended and developed as times goes by. The powers of the inspector include finding-out and establishing the circumstances of the committed crime as well as establishing the person who committed a crime.
The present paper includes introduction, three chapters, conclusion and appendix. The powers of the inspector in criminal procedure are of great importance because investigation is the first step in forming the basis of conviction.
After examining the powers of the inspector, the author used laws and resolutions where were shown the general and special powers of the inspector.
