Laulāto mantiskās attiecības un ar to saistītās problēmas Latvijā

Abstract

Bakalaura darbs ir izstrādāts par laulāto mantiskām attiecībām un ar to saistītām problēmām Latvijā, jo laulāto mantisko attiecību tiesiskais regulējums LR tiesību sistēmā nav sakārtots, kas saistīts ar to, ka spēkā esošo tiesību aktu normas ir pretrunīgas, nepilnīgas.

Darba izstrādes gaitā autore, analizējot laulāto mantisko attiecību tiesisko regulējumu, tiesu praksi, juridiskajā literatūrā paustās atziņas, secināja, ka laulāto mantisko attiecību tiesiskais regulējums LR ir nepilnīgs, pretrunīgs. Autore darbā ir izteikusi vairākus priekšlikumus, kā uzlabot laulāto mantisko attiecību tiesisko regulējumu, lai CL un citās materiālās tiesību normās attiecībā uz laulāto mantiskām attiecībām samazinātu pretrunas un trūkumus.

Topic of this bachelor thesis „Matrimonial property rights and problems related to them in Latvia” has be developed in the matrimonial property legislation LR legal system does not imply that due to the fact that the existing legislative provisions are contradictory, incomplete.

Work the author of the analysis of matrimonial property legislation, case law, legal literature, the findings showed that the matrimonial property law LR is incomplete, contradictory. The author has made a number of proposals to improve the matrimonial property legislation, the CL and the other substantive provisions relating to matrimonial property regimes to reduce the discrepancies and deficiencies.
