Tiesiskās paļāvības principa piemērošana administratīvajā procesā.

Iestādes un tiesas, izskatot lietas administratīvā procesa ietvaros, samērā bieži saskaras ar gadījumiem, kad pieteicējs atsaucas uz tiesiskās paļāvības principu kā „pēdējo” argumentu sava prasījuma pamatošanai. Pārsvarā šajās lietās pieteicēji norāda, ka tiem bijusi tiesiskā paļāvība, nepierādot tiesiskās paļāvības principa piemērošanai nepieciešamos sastāvu, un atstājot iestādei un tiesai pašai izvērtēt šī sastāva esamību vai neesamību. Savukārt gadījumos, kad pieteicējs ir norādījis uz tiesiskās paļāvības principa sastāva pamatojošajiem pierādījumiem (faktiem), pieteicējs nevērtē vai ignorē iespējamo vispārējo tiesību principu sadursmi attiecīgās lietas ietvaros.
Šajā darbā ir apkopotas un analizētas izteiktās nostājas saistībā ar tiesiskās paļāvības principa piemērošanu Augstākās tiesas Senāta administratīvo lietu departamenta spriedumos laika periodā no 2009. gada 1. janvāra līdz 2010. gada 31. jūlijam, Patentu valdes Apelācijas padomes lēmumos, kā arī atsevišķos Eiropas tiesas nolēmumos, tādējādi iegūstot šī principa piemērošanas apgabalu (vadlīnijas). Authorities and the courts handle cases by administrative action rather often encounter cases in which the applicant relies on the principle of legitimate expectations, as the “last” argument in support of his claim. Mostly in these cases the applicants indicate that they had a legitimate expectation, without proof of principle of legal certainty required for the application composition, and leaving the body and the court itself to consider the composition of the presence or absence. By contrast, when the applicant has indicated to the legitimate expectations of the principle stock underlying evidence (facts), the applicant not consider or ignore alleged clash of common law principle in the case.
This work will be collated and analyzed the positions expressed in relation to the legitimate expectations principle in the Supreme Court Administrative Cases Department of judgments during the period from 1 January 2009 to July 31 2010, the Patent Office appeal board, as well as in some European court rulings, thereby resulting in the application of the principle areas (guidelines).
