Vārda brīvība: negatīvās brīvības robežu problēma liberālisma filosofijā.

Abstract

Darba mērķis ir noskaidrot, cik tālu sabiedrība var iejaukties indivīda rīcībā, kad sabiedrības vairākumam šķiet, ka indivīda rīcība nodara kaitējumu. Lai robežu noteiktu tiek analizēti divi autori – Džons Stjuarts Mills un Ronalds Dvorkins. Darba uzdevumi ir, pirmkārt, aplūkot, kā vārda brīvību ietekmē kaitējuma princips. Otrkārt, analizēt, vai kaitējums var būt pamats pornogrāfijas aizliegumam, kā arī noskaidrot argumentus par labu pornogrāfijas atļaušanai. Rezultātā var secināt, ka Dž.S.Mills kaitējumu nosaka caur vārda brīvību un atļauj iejaukties indivīda darbībā tikai, kad tiek pārkāpta publiskā morāle, kuru veido indivīdi. Savukārt R.Dvorkins aizstāv tiesības, kas paredz vienlīdzīgas rūpes un cieņu pret visiem. Atslēgas vārdi: Dž.S.Mills, R.Dvorkins, kaitējums, vārda brīvība, pornogrāfija.

The purpose of the Bachelor thesis is to find out how far the society can interfere in an individual’s life, if the society thinks that the individual has done harm. Two thinkers are analyzed in order to determine the border – John Stuart Mill and Ronald Dworkin. The thesis first of all views the effect of the principle of harm in freedom of speech. Secondly thesis deals with the problem whether harm can be enough strong reason to prohibit pornography. As well as thesis tries to find out the arguments for permissive policy of pornography. The results show that J.S.Mill defines the harm through freedom of speech and allows to interfere in an individual`s life only when one breaks the public customary which is made by members of the society. Though R.Dworkin defends the individual’s right to equal concern and respect. Key words: J.S.Mill, R.Dworkin, harm, freedom of speech, pornography.
