Abstract

Bakalaura darba "Taisnīguma un tiesību korelācija: filosofiskie aspekti" mērķis ir noskaidrot taisnīguma un tiesību korelāciju un filosofiskus aspektus dažādu tiesību filosofijas tradīciju pārstāvju darbos: Kelzena, Radbruha un Roulza, kuri pelnījuši ievērojamu uzmanību mūsdienu diskursā par taisnīgumu. Darba uzdevumi ir: definēt tiesību filosofijas pamata tradīcijas; noskaidrot Kelzena, Radbruha un Roulza teoriju galvenās idejas, veikt salīdzinošu analīzi un izdarīt secinājumus par kopīgām un atšķirīgām iezīmēm. Bakalaura darba tēmas aktualitāti nosaka sociāli politiskie procesi mūsdienu sabiedrībā. Taisnīguma kategorijai un tās adekvātai izpratnei ir arvien lielāka nozīme likumdošanas un tiesas spriešanas procesā. Darba rezultātā autore noskaidrojusi pētīto filosofu galvenās idejas un atklājusi taisnīguma un tiesību koncepciju salīdzinošus aspektus. The aim of the thesis „Correlation of Justice and Law: Philosophical Aspects” is to investigate the correlation between justice and law and to examine the philosophical aspects of different law traditions represented by Kelsen, Radbruch and Rawls, who receive considerable attention in the contemporary discourse on justice. The tasks of this thesis are: to define the main traditions in law philosophy; to explore the main ideas of Kelsen's, Radbruch's and Rawls's theories; to make a comparative analysis and to draw conclusions on the common and different aspects. Relevance of the topic chosen is defined by the social and political processes in the modern society. Category of justice has significant importance in legislative and judicial process. In the conclusion of this thesis the author highlighted the main ideas of the analysed philosophers and disclosed the comparative aspects of the concepts of justice and law.
