Valsts tiesību aktu saderība ar ES tiesību aktiem par brīvību sniegt seksuālos pakalpojumus

Abstract

Eiropas Savienības dalībvalstīs, pamatjautājumi par prostitūciju ietilpst nacionālajā kompetencē. Tādējādi dalībvalstīs ir dažāds nacionālo tiesību aktu regulējums, par prostitūciju, kuru mērķis, galvenokārt ir, kontrabandas apkarošana, vairumā gadījumu ignorējot "brīvprātīgu" prostitūtu esamību un viņu tiesības. Šis darbs apskata iespējamo brīvības pārkāpumu sniegt seksuālos pakalpojumus ES teritorijā. Analizējot dalībvalstu nacionālos tiesību aktus, attiecībā uz prostitūciju un judikatūru KT, darbā tiek konstatēts, ka, ja dalībvalsts atļauj prostitūciju (saskaņā ar nacionālajiem tiesību aktiem vai pastāvošo praksi) saviem pilsoņiem, tad tās nevar kavēt pārējo dalībvalstu pilsoņus sniegt seksuālos pakalpojumus.

General issues regarding prostitution fall under the national competence of Member States of the European Union. Thus, Member States have different national legislations on prostitution aiming mainly to combat trafficking and ignoring in most cases the existence of “voluntary” prostitutes and their rights. This thesis examines the possible violations of freedom to provide sexual services within the European Union. By analyzing the national legislations of Member States on prostitution and case law of the Court of Justice, the thesis finds that if Member state allows prostitution (under the national law or in practice) for its own nationals, then it cannot prevent the nationals of other Member States to provide sexual services.
