Ārzemnieku uzturēšanās nosacījumu nepilnības Latvijas Republikā un Eiropas Savienībā
Zusammenfassung
Maģistra darbs “Ārzemnieku uzturēšanās tiesiskā regulējuma nepilnības Latvijas Republikā un Eiropas Savienībā” izstrādāts izvērtējot virkni starptautisku tiesību aktu, kā arī veicot Latvijas Republikas normatīvo aktu atbilstību pastāvošajām starptautiskajām tiesību normām. Darbā izvērtēta valsts un ārzemnieka tiesiskās attiecības, kā arī ārzemnieka atbildība par iepriekš minēto tiesību normu neievērošanu.
Darba aktualitāti nosaka dotās tēmas izpēte, kad jaunas tiesību sistēmas ietvaros, kas izveidojusies Latvijas Republikai kļūstot par Eiropas Savienības dalībvalsti, kā arī pievienojoties Šengenas līguma dalībvalstīm.
Maģistra darba pirmajā nodaļā autors ir izvērtējis kopējo situāciju migrācijas jomā sniedzot savu viedokli par migrācijas procesu attīstību Eiropā .
Maģistra darba otrajā nodaļā izvērtēta Eiropas Savienības tiesību sistēma un tās ietekme uz Latvijas Republikas tiesību sistēmu.
Maģistra darba trešajā nodaļā autors ir aprakstījis Latvijas Republikas valsts institūciju kompetenci un pamatpienākumus migrācijas procesu regulējumā
Maģistra darba ceturtajā nodaļā tik atspoguļoti sadarbības aspekti starp Eiropas Savienību un trešajām valstīm nelegālās migrācijas novēršanas jomā.
Izvērtējot Latvijas Republikas tiesību aktu regulējumu un to atbilstību Eiropas Savienības tiesību aktiem, autors ir devis tiesību aktu kolīziju piemērus un priekšlikumus tiesību sistēmas harmonizēšanai. The master thesis “Incompleteness of Legal Regulation of Residence of Foreigners in the Republic of Latvia and the European Union” has been elaborated by considering plenty of international legal acts and by assessing conformity of legislation of the Republic of Latvia to existing international legal acts. Legal relations between the state and a foreigner as well as responsibility of a foreigner for inobservance of the aforementioned legal acts have been considered in the master theses.
Topicality of the master thesis is determined by research of the current topic, when in the framework of new legal system established after accession of the Republic of Latvia to the European Union as well as joining to the Schengen Treaty member states.
The author has researched the common situation in migration field delivering his own opinion concerning development of migration process in Europe in the first part of the master thesis.
The legal system of the European Union and its impact on the legal system of the Republic of Latvia has been investigated in the second part of the master thesis.
The author has described the competency of governmental institutions of the Republic of Latvia and basic obligations relevant to regulation of migration processes in the third part of the master thesis.
Aspects of cooperation among the European Union and third countries in field of prevention of illegal migration have been reflected in the fourth part of the master thesis.
While considering regulation of the legal acts of the Republic of Latvia and conformity thereof to the legal acts of the European Union, the author has provided illustrations of collision of legal acts and proposals for harmonization of the legal system.
