Eiropas Savienības tiesību aktu izstrāde atbilstoši daudzvalodu principam

Abstract

Bakalaura darba mērķis ir noskaidrot un analizēt kā daudzvalodu princips ietekmē Eiropas Savienības tiesību aktu izstrādi, to ieviešanu dalībvalstīs un spēkā esamību, ņemot vērā, ka šobrīd Eiropas Savienību jau veido 28 dalībvalstis, kurās ir 24 oficiālās valodas, kuras ir vienlīdzīgas, kā arī konstatēt problēmas un to risinājumus minēto tiesību aktu izstrādē un ieviešanā. Darba gaitā tika aplūkota daudzvalodu principa būtība, vēsturiskā izveide un juridiskie aspekti Eiropas Savienības kontekstā, ņemot vērā Eiropas Savienības izveides ideju visās tās darbības jomās, proti, ka Eiropas Savienība ir vienots veselums, kurā tiek ievērotas un cienītas tradīciju un valodu atšķirības, tostarp tas attiecas uz tiesību aktu izstrādi un piemērošanu, kā arī tika analizēti dažādi juridiskie un valodas aspekti, lai atklātu minēto tiesību aktu izstrādes īpatnības un sniegtu secinājumus un ieteikumus kvalitatīvākai to sagatavošanai. Lai uzrakstītu šo darbu, apkopoju un analizēju vēsturisko informāciju, juridisko bāzi un dažādas publikācijas par Eiropas Savienības tiesību aktu izstrādi. Izpētes rezultātā, esmu nonākusi pie secinājuma, lai arī ES tiesību aktu izstrāde 24 oficiālajās valodās ir sarežģīts un darbietilpīgs process, tomēr tas nodrošina, minēto tiesību aktu efektīvāku ieviešanu, pieejamību un izpratni, ne vien juristiem, bet arī jebkuram Eiropas pilsonim, tādējādi sekmējot ES darbības pamatprincipa izpildi.

The purpose of the Bachelor Paper is to find out and analyze how multilingual principle influences drafting of the EU legislation, their implementation and validity in the EU Member States taking into account the fact that the European Union consists of 28 Member States having 24 official authentic languages, as well as to state problems and their solutions in the drafting and implementation of the above-mentioned legislation. During the writing of the Bachelor Paper the essence of the multilingual principle, its historic development, as well as legal aspects in the EU context were examined taking into consideration the general idea of the establishment of the European Union in all its activities, namely, the fact that the European Union is a single entity where differences of traditions and languages are respected, including the drafting and implementation of the EU legislation, as well as different legal and language aspects were analyzed in order to discover specifics of the drafting of the EU legislation and to provide conclusions and recommendation for the drafting of higher quality. In order to write the Bachelor Paper historic information, legal bases and relevant publications on the drafting of the EU legislation were collected and analyzed. As a result of the research the author reached the conclusion that notwithstanding the fact that the drafting of the EU legislation in 24 official languages is a complicated and laborious process, thus it provides more effective implementation, access and understanding not only for lawyers but any European citizen in this way promoting execution of the basic principles of the EU functioning.
