Komunikācijas ētika tiesas procesā, kā tiesības uz taisnu tiesu

Abstract

Maģistra darba nosaukums ir „Komunikācijas ētika tiesas procesā, kā tiesības uz taisnu tiesu”. Autors uzskata, ka izvēlētā darba tēma ir aktuāla, un kamēr Latvijas Valsts tieksies uz tiesu sistēmas modernizāciju, tā pētīs situāciju komunikācijas ētikas jomā. Jāuzsver ir darba novitāte, šo jautājumu latviski, šādā griezumā, neviens nav pētījis. Maģistra darba mērķis ir izpētīt komunikācijas ētikas nozīmi tiesas procesos, kā arī sniegt secinājumus un priekšlikumus, kas radušies darba izpildes gaitā. Mērķa sasniegšanai izvirzītie uzdevumi: izpētīt tiesību uz taisnu tiesu tiesiskos aspektus; tiesnešu ētikas regulējumu; komunikācijas ētikas regulējumu un praksi tiesas procesos; komunikācijas ētikas pārkāpumu raksturojumu un statistikas izpēti; sniegt secinājumus, kas radušies darba izpildes gaitā. Maģistra darbs sastāv no trīs nodaļām, darba pirmajā nodaļā tiks pētītas tiesības uz taisnīgu tiesu. Darba otrajā nodaļā autors pētīs tiesnešu ētikas tiesisko regulējumu, un tā nodrošināšanas mehānismus, savukārt darba trešajā nodaļā autors raksturos tiesnešu un tiesu varai piederīgo amatpersonu komunikācijas ētikas regulējumu praksi. Darba galvenais secinājums: Procesuālie principi nosaka tiesāšanās kārtību, kas ir visatbilstošākā taisnīgas tiesas nodrošināšanai katrā no procesiem, tomēr, kaut gan procesi ir atšķirīgi, komunikācijas ētikas izvirzītās prasības ir vienādas, tās ir balstītas uz neitralitātes un objektivitātes principiem un uz tiem principiem, kas ir nostiprināti likumā „Par tiesu varu”.

The title of master work is „Communication ethics in court proceedings, as the right to a fair trial”.The author believes that the chosen theme is topical and while the Latvian State will seek to modernize the judicial system, it will examine the situation of communication ethics.It should be emphasize the novelty of the work, the issue in such a Latvian perspective no one has studied. Master's thesis aims to explore the role of communication ethics proceedings, and to provide conclusions and recommendations arising from the process of work. The aim, arising from master work is: Explore the right to a fair legal aspects; the judicial ethics rules; the communication of ethical frameworks and practices in court proceedings; the communications misconduct characterization and statistical research; provide conclusions from the process of work. Master's work consists of three chapters, in the first chapter will be studied the right to a fair trial. The second chapter will explore judicial ethics legislation and assurance mechanisms. While working in the third chapter the author will describe judges and judiciary officials belonging to the ethical framework of communication practices. Key conclusion: Procedures for the adjudication of court cases are determined by procedural principles. Procedural principles are the most suitable means of ensuring a fairtrial. Although the processes differ from one another, the requirements of communication ethics remain the same, as they are based on the principles of neutrality and impartiality, and the principles laid down in the Law on Judicial Power.
