In-house izņēmuma vieta ES tiesības ir neskaidra. Vai princips, kas formāli izriet no publiskā iepirkuma tiesībām ir skatāms gan ES konkurences tiesību, gan valsts atbalsta konspektā? Situāciju vēl vairāk sarežģī in-house izņēmuma attiecības ar citu specifisku ES tiesību nozari - vispārējas tautsaimniecības nozares pakalpojumiem.
In-house būtībā atļauj nerīkot publisko iepirkumu situācijā, kad tas būtu normāli jādara, ja tikai pašvaldībai vai iestādei ir iespējas publisko līgumu uzticēt sev piederošam uzņēmumam. Tādā veidā var tikt apiets brīvais tirgus un konkurence kā tāda, kas noteikti nav vēlams pasākums ilgtermiņā.
Darbā tika noteikts, regulējuma apjoms, kas attiecas un in-house izņēmuma pielietošanu. Sākot no Eiropas Savienības Tiesas judikatūras analīzes, apskatot in-house izņēmuma saturu, proti, tā kritērijus un to attīstību, turpinot ar LESD 102.panta un LESD 107.panta regulējuma attiecināšanu. In-house exception’s place in EU law is cloudy. Should this principle which formally arises from public procurement regulations be taken into account regard competition law and state aid? The situation is even further complicated by the in-house exceptions exclusive relationship with another sector specific EU legislation – the provision on services of general economic interest.
In-house exception allows circumventing the obligation to procure public contracts, if the contracting authority can entrust the public service to a public company usually owned by the contracting authority itself. In such a way the market of the EU may be distorted and negative effects made on the competition, which in long-term could be a considerable problem.
The study determined the amount of regulation to be applied to in-house exception. Beginning with the case law of the ECJ, regarding the criteria of the exception as established by court, finishing with the application of articles 102. and 107, of the TFEU to the in-house exception.
