ECT prakse personas goda un cieņas aizsardzībā

Abstract

Mūsdienās, attīstoties tehnoloģijām un internetam ieņemot galveno plašsaziņas līdzekļa lomu, arvien aktuālāks kļūst jautājums, kā personai aizsargāt savas tiesības uz godu un cieņu reizē pārāk neierobežojot tiesības uz vārda brīvību, kas ir demokrātiskas sabiedrības stūrakmens. Autore darbā sniedz ieskatu tiesību uz godu un cieņu aizsardzībā, to līdzsvarošanā ar tiesībām uz vārda brīvību, kā arī sniedz izklāstu, apskatot ECT un Latvijas tiesu praksi un to salīdzinot. Tāpat autore apskata un sniedz secinājums par to, kā no tiesībām uz goda un cieņas aizsardzību izriet valsts pozitīvais pienākums šīs tiesības normatīvi aizsargāt, un kā tieši to ir nodrošinājusi Latvija savā tiesību sistēmā, tostarp gadījumos, kad personas godu un cieņu ir aizskāris anonīms komentētājs.

The rapid technological developments and the vast scope of information available on the internet raises the question, how to find balance between the rights to honour and dignity and freedom of speech which is the corner stone of democracy. The author presents an insight to the protection of the right to honour and dignity, the balance of these rights between freedom of speech, and also outlines the differences in ECHR and Latvian court case law. The author also examines and provides conclusions on positive obligations that a country has to ensure the protection of honour and dignity through laws and regulations, and specifically how this is established in Latvian legal system, including situations when honour and dignity of peron has been violated by anonymous commentator.
