Interneta ietekme uz Eiropas Savienības Tiesas judikatūru

Abstract

Bakalaura darbs „Interneta ietekme uz Eiropas Savienības Tiesas judikatūru” sniedz ieskatu par izmaiņām, kuras radījusi tehnoloģiju attīstība, Eiropas Savienības tiesībās. Bakalaura darba mērķis ir izprast, kādu ietekmi internets ir radījis trīs konkrētās jomās – Eiropas Savienības iekšējā tirgū, intelektuālā īpašuma aizsardzībā un personas datu aizsardzībā. Kā arī izprast Eiropas Savienības Tiesa viedokli attiecībā par interneta ietekmi uz šīm trīs tēmām un kādas ir šo tehnoloģisko izmaiņu radītajās problēmas. Lai sasniegtu darba mērķi, tika veikta Eiropas Savienības Tiesas prakses analīze, padziļināta juridiskās literatūras un normatīvā regulējuma izpēte un konstatēti trūkumi un nepilnības Eiropas Savienības tiesiskajā regulējumā. Darba autore galvenokārt secināja, ka Eiropas Savienībā nav vienots un pietiekams tiesiskais regulējums iepriekš minētajās jomās. Darba autore ir piedāvājusi iespējamos risinājumus, kā arī vērtējusi jau pastāvošos risinājumus Eiropas Savienības ietvaros.

Bachelor`s thesis „Internet`s influence on the European Court of Justice case-law” provides an insight on the changes fueled by the exponential progress of technology, viewed in the context of European Union rights. The goal of the thesis is to understand the impact of these changes upon three specific areas – The internal market of European Union, intellectual property rights, data protecton. A further goal is to understand the viewpoint of European Court of Justice on the magnitude of which the internet has a negative effect on the aforementioned spheres. To achieve the goal of this thesis, an analysis on the practice of European Court of Justice will be made. Secondly, research on the judicial literature and legislative regulation will be committed and possible errors and imperfections found and analyzed. The author of the thesis concluded, that European Union lacks a united and efficiently applicable legislative regulation in regarding aforementioned spheres. The author of the theses has provided possible solutions also she has analyzed existing solutions within EU.
