Notāru loma sociālo procesu regulēšanā: Laulības šķiršanas un iespējamās noslēgšanas piemērs

Abstract

Ņemot vērā, to, cik lielas izmaiņas ir piedzīvojis notariāts, tiesu sistēma un sabiedrība, jāatzīst, ka maz pētīts tas, kā ir mainījusies zvērinātu notāru loma. Darba mērķis ir pierādīt, ka, neskatoties uz to, ka zvērināti notāri ir tiesu sistēmas juridiskā profesija, kuras funkciju pildīšana pamatā tiek saistīta ar privāttiesību jomu, notāru profesionālā darbība atstāj ietekmi arī uz personas sociālo jomu dzīvē. To autore centīsies panākt, analizējot visu zvērināta notāra profesiju, bet, pastiprināti pievēršot uzmanību, zvērinātu notāru lomai laulībā, proti, analizējot laulību šķiršanu zvērinātu notāru izpildījumā, kā arī pētot, vai zvērinātiem notāriem vajadzētu ļaut slēgt laulības.

Considering the amount of changes implemented on notary, legal system and society, we need to recognize that there is a lack of researches on the changes of the role of sworn notaries. The main goal of this research is to prove that, despite sworn notary being a legal profession of judicial system and performing functions that, in their roots, are closely tied to private law, the professional actions of notaries leave an impact on person’s social role as well. In order to achieve this goal the author of this research analyses the profession of sworn notary as a whole, but paying special attention to the role of sworn notaries in marriage, respectively, the author analyses annulments of marriage conducted by sworn notaries and researches whether or not they should be granted the function to conduct marriage as well.
