In this bachelor paper the author concentrates on the field of family law, more specifically - the rights of the biological father to determine child’s filiation. This is an important issue since father's rights to family and family life are legally complicated and disproportionately restricted. This is most apparent when dealing with child’s best interests. Comparing the father’s and mother’s rights to determine child’s filiation, the father is in an unequal position compared to the child's biological mother.
The author has analyzed the current legal framework in Latvia concerning the rights of a biological father. The emphasis lies on the rights to establish and contest paternity, compared to other European countries, primarily, Germany. This work analyzes opinions of different authors, as well as Latvian and international judicial practice in the field.
As a result of investigation, the author identifies imperfections in laws and regulations and offers possible problem solutions. These include proposals for the amendment of the law to organize the rights of the child's biological father.
Keywords: biological father, paternity, determination of child's filiation, presumption of paternity.
