Zemes īpašuma robežu veidošanas process lauku apvidos un ar to saistītie problemātiskie aspekti

Darbā tiek apskatīts zemes īpašuma robežu veidošanas process un tā problemātiskie aspekti Latvijas Republikas lauku apvidos zemes reformas laikā. Tajā atklājas zemes reformas sarežģītā daba un problemātiskās tiesiskās attiecības starp zemes vienību lietotājiem/īpašniekiem un valsti, kas radušās no valsts pieļautajām kļūdām minētā procesa īstenošanas laikā līdz 2006.gadam. Tiek konstatēts, ka lielākā daļa kļūdu radās valstij nepietiekoša finansējuma, tehniskā nodrošinājuma, profesionālu cilvēkresursu un vājās administrācijas dēļ. Darba gaitā tiek konstatēts, ka valsts par savām pieļautajām kļūdām minētajā procesā līdz 2006.gadam uzņemas nepietiekamu atbildību, nenosakot skaidras robežas tās tiesībās grozīt zemes vienības lietojuma vai īpašumtiesību apjomu. Autora ieskatā, zemes lietotājiem/īpašniekiem piemīt tiesiskā paļāvība, ka to zemes vienības tiesiskajos dokumentos minētais tiesību apjoms netiks samazināts par normatīvajos aktos noteikto pieļaujamās nesaistes apjomu. The paper deals with the process of formation of land boundaries in rural area and its problematic aspects during the land reform in the Republic of Latvia. In the paper author acknowledges that the land reform’s complicated nature and its problematic legal relationships between landholders, landowners and the state, which have appeared from the mistakes made by state in the mentioned process until 2006. The author concludes the lack of adequate financial, technical, professional human resources and weak administrative process was the reason for the most of the mistakes. The author recognizes that the state doesn’t carries enough liability for its mistakes and that it doesn’t draws a clear line where its authority ends in the process of narrowing landholder’s/landowner’s rights included in the legal documents of their land plots.
