Tiesu galvenā funkcija ir konfliktu risināšana, savukārt dialogs ir vislabākā konfliktu risināšanas metode. Tas ļauj sagādāt un apstrādāt konflikta risināšanai būtisko informāciju, nodrošinot pēc iespējas augstvērtīgāka risinājuma rašanu. Tādējādi jo pilnīgāks ir tiesas procesā notiekošais dialogs, jo kvalitatīvāka ir tiesas spriešana. Tomēr tiesas spriešanas kvalitāte ir tikai viens no nosacījumiem tiesu spējai sasniegt savu galveno mērķi – taisnīgu lietas risinājumu. Otrs nosacījums ir tiesas spriešanas kvantitāte, jo tiesām jāspēj laikus izskatīt visas saņemtās lietas. Tāpēc, lai starp kvalitāti un kvantitāti panāktu līdzsvaru, dialogs var tikt ierobežots. The main function of the courts is to resolve conflicts, whereas the dialogue is the best method of conflict resolution. The dialogue allows to obtain and process the information relevant to conflict resolution ensuring creation of solution of possibly high quality. The more complete the dialogue, the highest-quality the adjudication. The quality of adjudication is, however, only one of the preconditions for capacity of the courts to achieve their major objective – to arrive at a fair case solution. The second precondition is the quantity of adjudication, as courts must be capable of deciding all the incoming cases in time. Therefore in order to achieve balance between the quality and the quantity, the dialogue may be restricted.
