Apdrošināšanas brokeru darbības tiesiskā regulējuma problēmjautājumi.
Zusammenfassung
Darba mērķis ir veikt apdrošināšanas brokeru tiesiskā regulējuma analīzi un tā problēmjautājumu apzināšanu. Darba mērķa sasniegšanai autore veic Eiropas Savienības apdrošināšanas starpniecības regulējuma apskati kontekstā ar Latvijas normatīvo regulējumu. Problēmjautājumu identificēšanai ir nepieciešams noteikt un apskatīt: apdrošināšanas starpniecības definējumā ietilpstošo personu loku, apdrošināšanas starpnieku reģistrācijas un uzraudzības prasības, apdrošināšanas starpniekiem izvirzāmos profesionālos kritērijus, kā arī klienta un apdrošināšanas starpnieka attiecībām piemērojamo regulējumu. Pētījuma rezultātā autore piedāvā darba gaitā konstatēto problēmjautājumu risināšanas priekšlikumus un tiesiskā regulējuma nepilnību novēršanu. To reach the aim author study and compare the European Union regulation on insurance mediation jointly with Latvian regulations. To identify the key questions it is necessary to determine the range of persons falling under the scope of insurance intermediaries, insurance intermediaries’ registration criteria and supervising requirements, the professional standards of insurance intermediaries and regulations applying for relationship in between clients and intermediaries. As the result author identifies the main insurance mediation regulation problems and provides the suggestion how identified problems can be solved.
