Bakalaura darbā tiek rakstīts par nepieciešamo aizstāvēšanos, kas ir viens no apstākļiem, kas izslēdz kriminālatbildību. Autore uzskata, ka izvēlētais temats ir aktuāls, jo jautājums par nepieciešamo aizstāvēšanos ir sagādājis grūtības vairāku gadsimtu garumā līdz pat mūsdienām. Nepieciešamā aizstāvēšanās ir viens no sarežģītākajiem institūtiem, jo tas sagādā grūtības ne vien personai, kura aizstāvas, bet arī tiesām, kas dažkārt izskaidrojams ar nepamatotiem tiesas spriedumiem. Darba mērķis - izpētīt nepieciešamās aizstāvēšanās vēsturisko attīstību, jēdzienu, noskaidrot nepieciešamās aizstāvēšanās nosacījumus un nosacījumu pārkāpšanu. Darba uzdevumi: 1)izpētīt vispārīgi nepieciešamās aizstāvēšanās vēsturisko attīstību; 2)izpētīt nepieciešamās aizstāvēšanās jēdzienu un būtību; 3)izpētīt nepieciešamās aizstāvēšanās tiesīguma nosacījumus, ar tiesu prakses palīdzību noskaidrot, kāpēc tiek pieļauta aizstāvēšanās robežu pārkāpšana un vai tiesa izvērtē nepieciešamās aizstāvēšanās tiesīguma nosacījumus taisot nolēmumus; 4)izpētīt nepieciešamās aizstāvēšanās regulējumu ārvalstīs; 5)sniegt savu viedokli un priekšlikumus. The Bachelor`s thesis is written about self-defense which is one of the circumstances which excludes the criminal liability. The author believes that the topicality of the chosen topic is important because the issue of the self-defense has caused difficulties for several centuries until today. Self-defense is one of the most difficult institutes, because it challenges not only the person who defends himself but also the courts which results in unjustified court judgements. Purpose of this Bachelor`s thesis is to explore self-defense historical development, concept, clarify the terms and conditions of the violation of self-defense. Objectives of this Bachelor`s thesis: 1)explore historical development of self-defense in general; 2)explore the concept and nature of self-defense; 3)explore self-defense eligibility conditions under case law to determine why exceeding the limits of self-defense is admitted and that whether the court assesses the eligibility conditions of legitimate self-defense in reaching its decisions. 4)explore foreign self-defense framework; 5)provide author’s viewpoint and proposals.
