Maģistra darbā autore pēta administratīvi tiesisko ietvaru pašvaldības rīcībai ar vidi degradējošām, sagruvušām vai cilvēku drošību apdraudošām būvēm (graustiem). Lai panāktu būvju sakārtošanu, likumdevējs normatīvajos aktos pašvaldībai ir deleģējis tādus tiesiskos līdzekļus kā būves īpašnieka (tiesiskā valdītāja) administratīvā sodīšana, būves sakārtošana vai nojaukšana piespiedu kārtā, kā arī paaugstinātās nekustamā īpašuma nodokļa likmes piemērošana. Tomēr šo tiesisko līdzekļu realizācija praksē ir sarežģīta, dažādu iemeslu dēļ problemātiska vai neiespējama, kā rezultātā pašvaldība pienācīgi nevar nodrošināt tās iedzīvotāju tiesības dzīvot drošā un sakārtotā vidē. Pētījuma ietvaros tiek identificēti galvenie problēmjautājumi, ar ko saskaras pašvaldība, īstenojot administratīvās procedūras attiecībā uz vidi degradējošu, sagruvušu vai cilvēku drošību apdraudošu būvju īpašniekiem (tiesiskajiem valdītājiem), kā arī piedāvāti atsevišķi priekšlikumi efektīvākai konstatēto problēmu risināšanai. In this Master thesis the author has studied the administrative legal basis for the operations with environment-degrading, collapsed buildings or buildings hazardous to personal safety performed by the Municipality. In order to improve the conditions of such buildings, in the regulatory requirements the legislator has delegated the Municipality competence to apply an administrative punishment on the owner of the building (legal holder), to demolish the building or bring it in order as a measure of constraint, or to apply a higher rate real estate tax. However, the practical implementation of these legal instruments is difficult, and for different reasons sometimes problematic or impossible, which results in Municipality not being able to secure the rights of its residents to live in a safe and well-sustained environment. In the framework of this study, the author has identified the main problematic questions which the Municipality faces when putting into action the administrative procedures aimed at the environment-degrading, collapsed or hazardous to personal safety buildings, also providing suggestions for more efficient solving the problems stated before.
