Abstract

Pierādāmo apstākļu kopums lietās par zādzībām, autoraprāt, izvirza trīs galvenos problēmjautājumus. Pirmkārt, mantas faktiskās vērtības noteikšana, otrkārt, zādzības, kas saistīta ar iekļūšanu telpā, treškārt, zādzība, kas izdarīta no transportlīdzekļa. Pētījuma mērķis ir sniegt viedokli par iepriekš minētajiem punktiem. Par katru no trīs minētajiem aspektiem autors izvirza savu redzējumu uz iespējamo problēmas risinājumu. Lai sasniegtu darba mērķi, autors aplūkoja un analizēja tiesas spriedumus, aplūkoja policijas vadlīnijas, kas saistītas ar kriminālprocesa vienkāršošanu par mazāk smagiem noziegumiem, kā arī darba laikā tika aplūkots ārvalsts regulējums, kas attiecas uz autora izvēlēto tēmu.

The author of the present study puts forward three key challenges in the demonstrable set of circumstances in cases of theft, namely, the actual value of the property, theft in connection with entering the premises, and theft, committed from the vehicle. The study aims to give an opinion on the aforementioned issues and to put forward and suggest the possible solutions. In order to achieve the goal of the research the author has reviewed and analysed court judgements, the police guidelines relating to the simplification of criminal proceedings for less serious crimes, and, furthermore, the research has sought to examine foreign legislation relating to the selected theme.
