Objektīvās izmeklēšanas principa pamatā ir ideja, ka procesā iesaistīto pušu starpā pastāv faktiskā nevienlīdzība, kuru ir iespējams līdzsvarot ar tiesas aktīvu līdzdalību procesa ietvaros. Šāds procesuāls princips Latvijas tiesību sistēmā ir pozitivizēts īstenošanai tikai administratīvā procesa tiesā ietvaros. Izvērtējot Satversmes tiesas specializēto kompetenci, pirmšķietami varētu šķist, ka Satversmes tiesas procesa ietvaros nav nepieciešamība īstenot objektīvās izmeklēšanas principu. Tādējādi rodas arī nepieciešamība izpētīt objektīvās izmeklēšanas principa īstenošanas iespējas Satversmes tiesas procesa ietvaros. Darba mērķis ir identificēt objektīvās izmeklēšanas principa īstenošanas iespējas Satversmes tiesas procesā. Darba mērķa sasniegšanai autors izpētīja no objektīvās izmeklēšanas principa satura izrietošās pazīmes, objektīvās izmeklēšanas principa īstenošanas iespējas citos Latvijas tiesību sistēmas procesa veidos, kā arī objektīvās izmeklēšanas principa īstenošanas iespējas Satversmes tiesas procesa ietvaros caur Satversmes tiesas prakses un Satversmes tiesas darbību un procesuālo kārtību regulējošo normatīvo aktu prizmu. Pētījuma rezultātā tika secināts, ka objektīvās izmeklēšanas princips tieši un nepastarpināti Satversmes tiesas procesā nav īstenojams, tajā pašā laikā ir identificējami procesuāli tiesību instrumenti, kas atzīstami par objektīvās izmeklēšanas principa īstenošanu Satversmes tiesas procesā tā saturiski sašaurinātā izpratnē. Darbs sastāv no 64 lappusēm, 3 nodaļām, 7 apakšnodaļām, kā arī 142 izmantotām literatūras un citu avotu vienībām. Darba pirmajā nodaļā tika izpētītas no objektīvās izmeklēšanas principa satura izrietošās pazīmes, kā arī objektīvās izmeklēšanas principa īstenošanas iespējas citos Latvijas tiesību sistēmas procesa veidos. Otrajā nodaļā tika izpētīti objektīvās izmeklēšanas principa īstenošanas teorētiskie aspekti Satversmes tiesas procesā. Savukārt, trešajā nodaļā izpēte tika veikta objektīvās izmeklēšanas principa īstenošanas praktiskajiem aspektiem Satversmes tiesas procesa ietvaros. Pētījuma rezultātā tika izdarīti 8 secinājumi. The basis of the principle of judicial inquiry is formed by the idea that there is actual inequality between the parties involved in the proceedings which can be equalised by active participation of the court within the framework of the proceeding. In the legal system of Latvia, such procedural principle has been made admissible only within the framework of administrative proceedings in court. Upon assessing specialised competence of the Constitutional Court, it might seem at the first site that within the framework of the proceedings of the Constitutional Court there is no necessity to apply the principle of judicial inquiry. Due to this reason, it is necessary to research the application of the principle of judicial inquiry within the framework of the proceeding of the Constitutional Court. The aim of the research is to identify the possibilities of application of the principle of judicial inquiry in the proceedings of the Constitutional Court. In order to reach the aim of the research, the author had an insight into the qualities originating from the content of the principle of judicial inquiry, the possibilities of application of the judicial inquiry principle in other types of proceedings in the judicial system of Latvia, as well as the possibilities of application of the principle of judicial inquiry within the framework of the proceeding of the Constitutional Court on the basis of the praxis of the Constitutional Court and the regulatory enactments regulating the operation and procedural order of the Constitutional Court. In the result of the research, the author has concluded that the principle of judicial inquiry cannot be applied to the proceedings of the Constitutional Court directly and without intermediation although some procedural legal instruments are to be identified that can be recognised as application of the principle of judicial inquiry to the proceeding of the Constitutional Court in the narrowest meaning of its content. The research consists of 64 pages, 3 chapters, 7 subchapters and 142 used literature and other source units. In the first chapter were researched the qualities originating from the contents of the principle of judicial inquiry and the application of the principle of judicial inquiry in other types of proceedings in the judicial system of Latvia. In the second chapter were researched the theoretical aspects on the application of the principle of judicial inquiry within the proceeding of the Constitutional Court. In the third chapter were researched the practical aspects on the application of the principle of judicial inquiry within the proceeding of the Constitutional Court.
