Maģistra darba „Valsts probācijas dienesta loma notiesāto resocializācijā” mērķis ir noskaidrot Valsts probācijas dienesta lomu notiesāto personu resocializācijā, pētot izmantojamos līdzekļus, problemātiku praksē un ārvalstu pieredzi. Izpētītas personu uzraudzības, izvērtēšanas ziņojumu un probācijas programmu funkcijas, juridiskie šķēršļi, Kanādas, Norvēģijas, Lielbritānijas un Igaunijas pieeja resocializācijas jomā. Pētījumā konstatēta nepieciešamība papildināt Latvijas Sodu izpildes kodeksa 156., 119.6 un 138.5 pantu ar nosacījumiem, kad probācijas klientam ir tiesības lūgt atļauju pastāvīgai dzīvošanai izbraukt no valsts. Secināts, ka tiesai elektroniskās uzraudzības noteikšanā jābūt vērīgākai pret izvērtēšanas ziņojumu. Krimināllikuma 45.1 panta septītās daļas normas teksts jāpārveido pēc Krimināllikuma 55. panta devītās nodaļas formulējuma, novēršot probācijas dienesta izvairīšanos noteikt pienākumus normas teksta nepilnību dēļ. The aim of the master's thesis „The role of the State Probation Service in resocialization of convicts” is to identify the role of the State Probation Service in resocialization of convicts, by studying the measures to be applied, challenges in praxis and experience abroad. The functions of person surveillance, assessment reports and probation programmes, legal constraints, the approach in resocialization field in Canada, Norway, Great Britain and Estonia have been studied. The study has identified the need to supplement the Article 156, 1196 and 1385 of The Sentence Execution Code of Latvia with provisions defining, when the probation client is entitled to request a permission to leave the country for a permanent residence abroad. It has been concluded that the court should be more attentive towards assessment report when deciding on electronic surveillance. The wording of the norm in Article 451 paragraph 7 of The Criminal Law must be modified according to the wording in Article 55 paragraph 9 of The Criminal Law to prevent the situations when probation service avoids the establishment of obligations due to shortcomings in the norm text.
