Maģistra darbā pētīts ieguldītāju un valsts strīdu izšķiršanas mehānisms no Eiropas Savienības tiesību perspektīvas, koncentrējoties uz starp dalībvalstīm noslēgtiem divpusējiem ieguldījumu aizsardzības līgumiem. Darba mērķis ir atbildēt uz jautājumu, vai šobrīd pastāvošais strīdu izšķiršanas mehānisms nepārkāpj ES tiesības, kā arī, kādi būtu risinājumi iespējamām nesaderībām. Darba uzdevumi bija cita starpā izvērtēt EST judikatūru un doktrīnu galvenokārt par LESD 344., 267. un 351. pantiem, secinot to tvērumu attiecībā uz divpusējiem ieguldījumu aizsardzības līgumiem, kā arī rast risinājumu iespējamai nesaderībai ar ES tiesību prasībām. Vietā šķiet Viljama Šekspīra mūžīgais jautājums, kas šajā darbā risināts kontekstā ar ieguldītāju un valsts strīdu izšķiršanu starp dalībvalstīm noslēgtajos divpusējos ieguldījumu aizsardzības līgumos: “Būt vai nebūt? Tāds ir jautājums.” The present master’s thesis includes the analysis of investor state dispute settlement procedure from the European Union Law perspective, focusing on bilateral investment agreements concluded between the member states of the European Union. The aim of this paper is to answer the question whether the present investor state dispute settlement procedure is consistent with the European Union Law and to provide possible solutions for the inconsistencies. The primary objectives of this paper are to analyze jurisprudence of the Court of Justice of the European Union mainly on Articles 344, 267 and 351 of The Treaty of the Functioning of the European Union in light of the current investor state dispute settlement procedure. The author finds relevant William Shakespeare’s famous quotation to be mentioned here in respect of the investor state dispute settlement: "To be or not to be? That is the question."
