Bērnu tiesību aizsardzības problemātika Latvijā valsts un pašvaldību sadarbības kontekstā

Abstract

Maģistra darba “Bērnu tiesību aizsardzības problemātika Latvijā valsts un pašvaldību sadarbības kontekstā” mērķis ir noskaidrot un izanalizēt biežākos bērnu tiesību pārkāpumus Latvijas izglītības iestādēs, kā arī izstrādāt priekšlikumus situācijas uzlabošanai. Izpildot darba mērķi, tiek pārbaudīta šāda hipotēze: valsts bērnu tiesību aizsardzības sistēma nespēj nodrošināt bērnu aizsardzību izglītības iestādēs pilnā apmērā. Lai sasniegtu mērķi, tiek uzstādīti sekojoši uzdevumi: analizēt institucionālisma teorētiskos aspektus; raksturot valsts un pašvaldību institucionālo sadarbības modeli Latvijā; analizēt starptautisko un Latvijas likumdošanu bērnu tiesību aizsardzības jomā, tostarp apskatot bērna tiesību jēdzienu; analizēt bērnu tiesību aizsardzības sistēmu un praktiskos mehānismus Latvijā; veikt papildu oriģinālu datu ieguvi ar kvantitatīvām metodēm un kvalitatīvām metodēm par bērnu tiesību aizsardzību Latvijā un šo datu analīzi. Mērķa sasniegšanai izmantota gan kvalitatīvā metode – intervijas ar bērnu tiesību aizsardzības jomā iesaistītajiem speciālistiem, to analīze, gan arī kvantitatīvā metode, ar ko tika veikta aptauja un iegūto datu analīze par izglītības iestādēs pastrādātu vardarbību pret bērniem. Darba gaitā tika secināts, ka Latvijā izveidotā bērnu tiesību aizsardzības sistēma likumdošanas līmenī ir atbilstoši izveidota, bet praksē nedarbojas atbilstoši likumdošanā noteiktajiem mērķiem, uzdevumiem, funkcijām resursu un speciālistu zināšanu un iemaņu trūkuma dēļ. Biežākie vardarbības veidi izglītības iestādēs pret bērniem ir emocionāla un fiziska vardarbība, kas tiek pastrādāta gan no skolas biedru, gan no pedagogu puses. Bet bērnu uzvedības traucējumi, kas noved pie vardarbīgām izpausmēm izglītības iestādēs, cēlonis meklējams ģimenēs. Lai risinātu secinājumos identificēto problemātiku, darbā tiek piedāvāti priekšlikumi, kas adresēti konkrētām institūcijām.

Aim of the master’s thesis “Protection of Children’s Rights in Latvia in the Context of Cooperation between the State and Local Government Institutions” is to determine and analyze the most often violations of children’s rights in the educational establishments (schools) of Latvia, as well as to elaborate proposals to improve the situation. To fulfil the aim of the thesis, the following hypothesis is verified: the system of protection of children’s rights in Latvia does not have the capabilities to ensure the complete protection of children’s rights in the educational establishments of Latvia. In order to fulfill the aim, the following tasks were determined: to analyze the theoretical aspects of institutionalism; to characterize the institutional cooperation model between the state and the local governmental institutions in Latvia regarding the protection of children’s rights, including a review of the child rights concept; to analyze the system of children’s rights protection and the practical mechanisms to implement it in Latvia; to gather additional original data with qualitative and quantitative research methods on the situation in with the protection of children’s rights in Latvia, and to analyze the respective data. Both qualitative and quantitative research methods are used – interviews with specialists involved in the children’s rights protection and analysis of that information, as well as surveying to acquire data on violence against children in the educational establishments in Latvia. As a result of the analysis in the thesis, it is concluded that the children’s rights protection system in Latvia at the legislation level is appropriate. However, in the practice it does not function according to the aims, tasks and functions defined in the legislation as a result of the lack of resources as well as lack of knowledge and skills of the specialists involved in the system. The most frequent cases of violence in the educational establishments in Latvia are the emotional and physical violence from the school fellows and teaching staff, as well as the behavior of other pupils that is negatively influenced by the behavioral deviations arising from issues in the respective families. To solve the problems identified in the thesis, proposals aimed at concrete institutions are elaborated in the thesis.
