Tiesību piemērošanas problemātika sauszemes transportlīdzekļu īpašnieku civiltiesiskās atbildības obligātās apdrošināšanas likumā

Abstract

Pētāmā darba mērķis ir izpētīt un analizēt Sauszemes transportlīdzekļu īpašnieku civiltiesiskās atbildības obligātās apdrošināšanas likuma piemērošanas problemātiku un rast risinājumu pareizai tiesību normu piemērošanai un tulkošanai izmantojot tiesību normu interpretācijas metodes. Darbā ir apkopota pētāmā likumā lietotās terminoloģijas problemātika un sniegti autores ieteikumi tās uzlabošanai. Aplūkoti ar šo likumu nenoregulētie problēmjautājumi un risinātu šo problēmjautājumu faktiskā atbilstība un piederību civiltiesiskās atbildības obligātās apdrošināšanas nozarei. Visbeidzot analizēti Latvijas Republikas tiesas spriedumi un tajos ietvertās atziņas attiecībā uz Sauszemes transportlīdzekļu īpašnieku civiltiesiskās atbildības obligātās apdrošināšanas likuma normu piemērošanu individuālu gadījumu risināšanā. The goal of research is to explore and analyze the Motor Third Party Liability Insurance law enforcement problems and find a solution to the proper law enforcement and interpretation by using the methods of legal interpretation. The thesis summarizes the terminology problems of and provides the author's recommendations for Motor Third Party Liability Insurance law improvement. The author has dealt with the non-adjusted issues of particular law as well as solved actual relevance of these non-adjusted issues to compulsory civil liability insurance sector in general. Finally there has been analyzed the court rulings and their insights to Motor Third Party Liability Insurance law by applying it in particular court cases.
