Ārstniecības personu krimināltiesiskā atbildība

Abstract

Maģistra darba mērķis ir izpētīt ārstniecības personu krimināltiesisko atbildību. Tiesu praksē ir grūtības analizēt materiālos sastāvus un noteikt cēloņsakarību starp ārstniecības personas krimināltiesisko atbildību un kaitīgajām sekām, arī subjekta jautājums. Maģistra darba uzdevumi ir: izpētīt maģistra darba tēmas tiesībvēsturisko aspektu, analizēt Krimināllikuma pantu kvalificējošās pazīmēs, citu valstu piemērus. Rezultātā autors izpētīja 77 avotus, izvirzīja 11 tēzes. Autors ierosina grozīt Krimināllikuma pantu dispozīciju, papildinot ar „ārstniecības personas, kas veic ārstniecību”, ieviest minimālo ekspertīžu skaitu cēloņsakarības noteikšanai starp ārstniecības personas izdarīto un kaitīgajām sekām, pārņemt citu valstu piemērus.

The aim of the master's thesis is to research the criminal liability of the medical personnel. Judicial practice shows that there are difficulties in analyzing the material compositions of the Latvian Criminal Code and establishing a causal link between the medical practitioners criminal liability and the harmful effects done by their actions, also the criminal subject is an issue. Master's thesis tasks are: to explore the legally-historical aspects of master's thesis topics, to analyze the Latvian Criminal Code articles qualifying characteristics also to study examples of foreign countries. As a result the author studied 77 sources and esthablished 11 theses. Author proposes to amend the Latvian Criminal Code medical personnel liability articles dispositions adding "medical practitioners performing medical treatment " to dispositions also to set the minimum number of examinations to determine the causal link between the medical practitioner actions and the harmful effects and incorporating some other legal regulations from foreign countries.
