Maģistra darba temats ir “Darba laika tiesiskais regulējums un ar to saistītās problēmas”. Temata aktualitāte saistāma ar darba laika nozīmīgu ietekmi uz darbinieka tiesību aizsardzību. Darba mērķis ir izpētīt darba laika regulējumu, sniegt viedokli un priekšlikumus apzināto problēmu risināšanai. Darba mērķi autore sasniedz, pētot un salīdzinot starptautisko, Eiropas Savienības, Latvijas un citu valstu normatīvo regulējumu, analizējot tiesu praksi un doktrīnu. Darba izstrādes procesā autore nonāca pie secinājuma, ka Eiropas Savienības un Latvijas regulējumam vairākos aspektos nepieciešama pilnveidošana un stingrākas kārtības noteikšana, tāpat konkretizācija nepieciešama dažiem EST spriedumiem. Darbs sastāv no četrām nodaļām. Pirmajā nodaļā tiek analizēts darba laika vispārīgs regulējums un jēdziens, otrajā nodaļā tiek analizēti darba laika veidi un organizācija, trešajā nodaļā tiek analizēts darba laiks īpašām darbinieku kategorijām un ceturtajā nodaļā – strīdu risināšana un atbildība par pārkāpumiem saistītiem ar trūkumiem darba laika organizācijā. The topic of master’s paper is "The legal regulation of working time and problem situations related to it". The relevance of the topic is related to the importance of working time to the protection of employee rights. The aim of the work is to research the regulation of working time, to express an opinion and suggestions for the conscious solutions of the identified problems. The aim of the work is reached by the research and comparison of the international, European Union regulation, the national laws of the European Union member states, including Latvian regulation, as well as the regulation of other countries, analyzing the case law and doctrine. In researching process, the author came to the conclusion that European Union and Latvian regulation need improvement and application of the stricter order, as well as some decisions of the Court of Justice of the European Union need to be more precise. The work consists of four parts. The first part considers the general regulation and the concept of working time. The second part comprises topics of the types and organization of working time. The third part describes the regulation of working time of specific categories of employees. The fourth part describes the procedure of dispute resolution and the responsibility of the break of working time. Keywords: labor law, working time, employer, employee, protection of employee rights.
