Valsts prezidents kā augstākā valsts amatpersona, lai gan noteiktās situācijās var būt kavēts izpildīt savu amatu, nepārtrauc pastāvēt, tāpat kā valsts kopumā un kāda atsevišķa institūcija nepārtrauc funkcionēt. Valsts prezidentu šādās situācijās aizvieto un parasti valstu konstitūcijās tam tiek paredzēts konkrēts regulējums. Turpretī Latvijas likumdevējs nav detalizēti izstrādājis Valsts prezidenta aizvietošanas regulējumu, un nereti rodas diskusijas un dažāda Satversmes interpretācija attiecībā uz Valsts prezidenta vietas izpildīšanu. Bakalaura darba “Valsts prezidenta vietas izpildīšanas regulējums Latvijā un ārvalstīs” rezultātā, analizējot Latvijas un citu valstu regulējumu, kā arī konstitucionālo tiesību praksi, konstatēts, ka Valsts prezidenta vietas izpildīšanas nianses katrā individuālā gadījumā atšķiras un tamdēļ būtu sarežģīti izstrādāt vienotu un izsmeļošu Valsts prezidenta aizvietošanas regulējumu, tāpēc darbā ir sniegti vispārīgi ierosinājumi Valsts prezidenta aizvietošanas institūta pilnveidošanai. The President of a state, being the highest official of a country, does not cease to exist, even if in certain circumstances he could be obstructed in carrying out his tasks; similarly, neither the country in general nor any of its institutions does never stop functioning. In this kind of circumstances the President is being substituted, and normally there is a special legal framework in the constitutions in that regard. Latvian legislator has not established detailed rules for the substitution of the President, and that often gives rise to discussions and different interpretations of Satversme. Bachelor`s paper “Legal framework for substitution of State President in Latvia and abroad”, after analyzing rules in Latvia and foreign countries, as well as the case – law in the domain of constitutional law, finds that in every individual case the details of legal framework are different, thus it would be extremely complicated to elaborate single legal mechanism for substitution of the State President. Therefore the paper provides general proposals in order to “fine-tune” that concept. Keywords: The President, Satversme, substitution, Saeima.
