Darbinieka komercnoslēpuma neizpaušanas pienākums
Zusammenfassung
Bakalaura darba mērķis ir noteikt darbinieka pienākumu glabāt un neizpaust darba devēja komercnoslēpumu darba tiesisko attiecību ietvaros un pēc tām, kā arī Latvijas Republikas un citu valstu normatīvo regulējumu attiecībā uz komercnoslēpuma piederību intelektuālā īpašuma tiesībām. Īstenojot mērķi, tiek apskatīti vairāki darba tiesību jautājumi saistībā ar darbinieka neizpaušanas pienākumu, kā arī konkurences ierobežojumu pēc darba tiesisko attiecību izbeigšanās. Autors norāda uz pieļaujamību noteikt Latvijas Republikas tiesību aktos komercnoslēpuma piederību intelektuālā īpašuma tiesībām, līdzīgi kā tas ir noteikts Pasaules Tirdzniecības organizācijas Līgumā par intelektuālā īpašuma tiesību komercaspektiem. The aim of the bachelor work is to determine the obligation for a worker to guard and undisclose a trade secret under employment and after the termination of employment relationship, as well as to determine the object of a trade secret as an Intellectual property object in the Latvian and other countries regulatory frameworks. In order to successfully achieve the said aim, author takes a thorough look through questions regarding the obligation of an employee to guard and undisclose the trade secret of an employer, as well as questions regarding the limitation of competition after the termination of employment relationship. Author adresses the possibility of determining trade secret as an Intellectual property in realm of Latvian regulatory framework, similar as it is in Article 39 of Agreement on Trade-Related Aspects of Intellectual Property Rights.
