Eiropas Cilvēktiesību un pamatbrīvību aizsardzības konvencijas (turpmāk - Konvencija) 16.protokols ir daļa no pasākumiem, kas tiek veikti Konvencijas ilgtermiņa reformu kontekstā. Ar to paplašina Eiropas Cilvēktiesību tiesas (turpmāk – ECT) rekomendējošo jurisdikciju un ievieš jaunu mehānismu Konvencijas cilvēktiesību aizsardzības sistēmā, atbilstoši kuram šī protokola dalībvalstu pēdējo instanču tiesas un tribunāli varēs lūgt ECT sniegt rekomendējošu viedokli. Darbā autors atklāj Konvencijas 16.protokola mērķus, analizē un pēta protokola saturu. Tiek secināts, ka regulējums kaut gan nepilnīgs, ir apmierinošs. Darbā arī tiek izvērtēta protokola nozīme un ietekme uz Konvencijas cilvēktiesību aizsardzības sistēmu un ES pievienošanos Konvencijai, kā arī izsvērta Latvijas iespējamā pievienošanos Konvencijas 16.protokolam. Tiek secināts, ka Konvencijas 16.protokols kopumā ir atbilstošs līdzeklis Konvencijas sistēmas reformu īstenošanā, un tas nerada ievērojamu apdraudējumu procesam, ar kuru ES pievienojas Konvencijai. Darba noslēgumā arī tiek secināts, ka ir stingri ieteicams Latvijai pievienoties Konvencijas 16.protokolam. Protocol No. 16 to the Convention on the Protection of Human Rights and Fundamental Freedoms (hereinafter “the Convention”) is part of the measures being implemented in the context of the Convention’s long term reform. It expands the European Court of Human Rights’ (hereinafter “the Court”) advisory jurisdiction and introduces a new mechanism in the Convention’s human rights protection system, under which the highest courts and tribunals of the protocol’s Parties will be enabled to ask the Court to give advisory opinions. In the thesis the author reveals the aims of Protocol No. 16 to the Convention, analyses and examines its content. It is concluded that the provisions although flawed, are satisfactory. Furthermore, in the thesis the author evaluates the significance and influence of Protocol No. 16 to the Convention to the Convention’s human rights protection system and the EU’s accession to the Convention. Latvia’s possibility of becoming a party to Protocol No. 16 to the Convention is also assessed. It is concluded that Protocol No. 16 to the Convention generally is an appropriate measure for the enactment of the Convention’s reforms and that it does not pose a real threat to the EU’s accession to the Convention. In the conclusion of the thesis, it is concluded that it is highly advisable for Latvia to become a party to Protocol No. 16 to the Convention.
