Ieslodzīto personu tiesības uz pieeju medicīniskajai aprūpei un valsts tiesības noteikt ierobežojumus starptautisko un nacionālo normu salīdzinājumā

Ieslodzītajiem ir tiesības uz veselības aprūpi, gan fizisko, gan garīgo, kas būtu vienlīdzīga ar to, kāda tiek nodrošināta pārējai sabiedrībai. Latvija ir pievienojusies daudziem starptautiskiem tiesību aktiem, kuri regulē medicīnas aprūpi un izvirza augstu standartu dalībvalstīm. Darba pirmajā nodaļā pētīts starptautiskais un Eiropas reģiona regulējums, nonākot pie secinājuma, ka tiesību normas un dažādās rekomendācijas ir savstarpēji papildinošas. Otrajā nodaļā pētīts Latvijas regulējums, institūciju atzinumi par atbilstību praksē, secinot, ka regulējums ir visai sadrumstalots un praksē tiesību aktos noteiktais ne vienmēr realizējas. Trešajā nodaļā pētīta Latvijas uzņemto saistību izpilde, secinot, ka, lai arī normatīvais regulējums ir atbilstošs, pastāv reālas problēmas ar īstenošanu un piemērošanu. Latvia has ratified many international documents that regulate health care and require that the member states provide a high standard of health care. The international regulation as well as the European regional regulation has been researched in the first chapter, concluding that the various provisions and recommendations are mutually complementary. The regulation of Latvia and the opinions of institutions regarding the conformity with normative acts have been researched in the second chapter, concluding that the regulation is quite fragmented and that the rules fixed in the legal acts are not always implemented. The execution of the obligations assumed by Latvia has been researched in the third chapter, concluding that despite the fact that the national normative regulation is appropriate, there are issues concerning the implementation and application of the legal acts.
