Lai arī kontinentālo tiesību valstu privāttiesības pirmslīgumisko atbildību paredz pat vairāk nekā 150 gadu, Latvijas privāttiesībās šī institūta teorētiskie aspekti un ieviešanas nepieciešamība ir maz pētīta. Bakalaura darbā “Pirmslīgumiskā atbildība” aplūkota culpa in contrahendo doktrīnas izcelsme, tās tvērums un mijiedarbība ar citiem privāttiesību institūtiem. Darbā analizēta pirmslīgumiskās atbildības sasaiste ar līgumu slēgšanas brīvību un citiem principiem kas izriet no delikttiesībām vai līgumtiesībām. Ar piemēriem no tiesu prakses ir ilustrētas pirmslīgumiskās atbildības dažādās izpausmes. Darba gaitā aplūkotas arī iespējas aizsargāt pirmslīgumiskās intereses, izmantojot Civillikuma normas. Although some Civil law countries are familiar with the notion of precontractual liability for more than 150 years, its theoretical aspects as well as necessity of implementation has not been discussed amongst Latvian legal scholars. Bachelor’s thesis “Precontractual liability” informs of the origins of culpa in contrahendo doctrine, its scope and interaction with other principles of private law. This research analyzes how precontractual liability interacts with the freedom of contract as well as other basic principles of tort and contract law. Common elements of precontractual liability are illustrated by case law. Possibility of seeking redress under Civil Code of Latvia in case of precontractual liability is also covered.
