Morālā kaitējuma kompensācija cilvēka nāves gadījumā: izpratne un piemērošanas problemātika.

Abstract

Bakalaura darba “Morālā kaitējuma kompensācija cilvēka nāves gadījumā: izpratne un piemērošanas problemātika” ietvaros pētīti teorētiskie un praktiskie morālā kaitējuma institūta aspekti saistībā ar personas nāves gadījumiem. Darbā izvirzīti mērķi izpētīt morālā kaitējuma kompensācijas specifiku personas nāves gadījumos, analizēt Latvijas un Eiropas valstu normatīvo regulējumu un tiesu praksi, kā arī apkopot un analizēt tiesību zinātnes un filozofijas atziņas par morālā kaitējuma kompensāciju cilvēka nāves gadījumos. Būtiskākie darbā izstrādātie secinājumi attiecas uz teorētisko pieeju dažādības atklāšanu saistībā ar morālā kaitējuma kompensācijas prasību mantojamību, uz atsevišķām Latvijas normatīvo aktu nepilnībām un uzlabošanas priekšlikumiem, kā arī uz kompensācijas funkciju saistību ar kompensācijas prasību morālo attaisnojamību.

In bachelor's “Compensation of non-pecuniary loss in the event of person death: conception and problems of application” theoretical and practical aspects of the compensation of moral damages in case of person death have been studied. The main purpose was to research specific aspects of the compensation of moral damages, to make analysis of legal regulations and case law (Latvia and other European countries), and to analyse the views of legal science and philosophy on the aspects of compensation for moral damages in death cases. The main conclusions are related to revelation of the variety of theoretical concepts about inheritance of claims for moral damages, also to the imperfections in the Latvian laws with proposals to improvement, and, finally, to the relation between functions of compensation and moral justification of the claims for moral damages.
