Bakalaura darbs ir veltīts neatņemamās daļas tiesīgo institūtam un to atstumšanai no mantojuma. Neapšaubāmi, līdz šīm, Latvijas tiesību zinātnieki ir veltījuši uzmanību šim institūtam, vairākkārt izskatījuši ar to saistītos problēmjautājumus, piedavājot iespējamos risinājumus, no kuriem daži tika arī ieviesti, modernizējot Civillikuma mantojuma tiesību daļu. Darba mērķis ir izpētīt neatņemamās daļas tiesīgo atstumšanas institūtu, salīdzinot Latvijas un citu valstu tiesiskos regulējumus, un izvirzīt pilnveidošanas un uzlabošanas priekšlikumus Latvijas regulējumam. Pētījuma rezultatā, izvērtējot konkrētas materiālo tiesību normas, tiek secināts, ka Civillikuma mantojuma tiesību daļā pastāv pretrunas, no kurām būtu vēlams izvairīties, lai panāktu vienotību tiesību normu piemērošanā atbilstoši aforismam „Par likumiem visiem ir jābūt vienādai izpratnei”. The work is dedicated to the institute of a preferentieal share and person’s exclusion from a preferential share of inheritance. This institute has already been widely studied by Latvian scientists of law, main problems were looked over, as a result some of them were solved by changing the Civil law in the part of inheritance. The aim of this work is to explore the institute of exclusion from a preferential share of inheritance comparing the Latvian regulation with that of another countries, to suggest some improvemets for the Latvian regulation. As a result of the research analising concrete norms of substantive law, it is possible to conclude that in the Latvian civil law in the part of inheritance there are some contradictions and it would be desirable to get rid of them so that to gain unity in using certain norms of law accordingly to the expression „For the law everybody should have an equal understanding”.
