Krāpšana un tās nodalīšana no citiem noziedzīgiem nodarījumiem

Maģistra darbā “Krāpšana un tās nodalīšana no citiem noziedzīgiem nodarījumiem” analizēta krāpšanas vēsturiskā attīstība, aplūkojot normatīvos aktus jau no 19.gadsimta sākuma, kad sāka veidoties krimināltiesību zinātne līdz pat mūsdienām. Pētījumā analizēta jaunākā Latvijas un ārvalstu juridiskā literatūra, tiesu prakse un tiesu prakses apkopojumi, lai konstatētu praksē esošās problēmas, norobežojot līdzīgus noziedzīgus nodarījumus – krāpšanu, apdrošināšanas krāpšanu, kukuļa piesavināšanos un izvairīšanos no nodokļu un tiem pielīdzināto maksājumu nomaksas, jo nereti tiesu praksē esot vienādiem faktiskajiem apstākļiem, tiek pieņemti diametrāli pretēji nolēmumi. Tā iemesla dēļ, ir sniegti ierosinājumi atsevišķu Krimināllikuma pantu precizēšanai, lai veicinātu vienveidīgas tiesu prakses attīstību. Pētījums sastāv no 3 nodaļām: pirmajā nodaļā aplūkota krāpšanas vēsturiskā attīstība, otrajā nodaļā analizēts krāpšanas sastāvs un trešā nodaļa veltīta iepriekš minēto noziedzīgu nodarījumu norobežošanai. The Master thesis Fraud and its Diversification from other Offences analyses historical development of fraudulence, looking into the legislation from the early 19th century, when Criminal science started to develop, till nowadays. Thesis analyses the latest Latvian and foreign legal literature, court practice and case law records, in order to determine the existing practical problems by damming similar criminal offenses - fraud, insurance fraud, misappropriation of bribes and tax evasion, because rather often diametrically opposite decisions are made in the case of equal factual circumstances. For this reason, the thesis suggests clarifying amendments in several articles of the Criminal Law, to promote a uniform court practice development. The research consists of three chapters: the first chapter deals with the historical development of fraud, in the second chapter the fraud content has been analyzed, and the third chapter is devoted to the separation of the aforementioned criminal offences.
