Аннотации
Maģistra darbs „Intelektuālā īpašuma aizsardzība muitas iestādē” sniedz ieskatu Latvijas tiesību sistēmā pastāvošajās problēmās attiecībā uz intelektuālā īpašuma tiesību aizsardzību muitā, salīdzinot muitas iestāžu darbību intelektuālā īpašuma tiesību aizsardzības jomā Latvijā un citās Eiropas Savienības dalībvalstīs. Darbs kopumā ir sadalīts trīs nodaļās, sākot ar intelektuālā īpašuma tiesību un viltoto preču jēdzienu analīzi un jautājuma par intelektuālā īpašuma tiesību tvērumu muitas darbību reglamentējošos normatīvajos aktos izpēti, turpinot ar pārkāpuma preču konstatēšanas kārtību Valsts ieņēmumu dienestā, un beidzot ar izvērstu muitas darbību reglamentējošo normatīvo aktu piemērošanas īpaši izdalāmo jautājumu apskatu. Darba noslēgumā izvirzīti secinājumi un priekšlikumi attiecībā uz nepieciešamajām izmaiņām tiesību aktos. Master’s thesis „Protection of intellectual property in customs authority” provides an insight on existing problems in Latvian legal system regarding the protection of intellectual property rights in customs authority by comparing the work carried out within the customs authority in Latvia and other European Union member states. Thesis consists of three main chapters, starting with the analysis of the concept of intellectual property rights and counterfeit goods and the question on the scope of the intellectual rights protection in legislative acts that lay down the rules and tasks for the customs authority, continuing further with the procedure on identifying the infringement in the State Revenue Service, and ending with thorough analysis of particular enforcement questions regarding the application of legislative acts that lay down the rules and tasks for the customs authority. Thesis is concluded by main findings and proposals with respect to the necessary amendments to the laws.
