Bezmantinieka mantas tiesiskais regulējums.

Abstract

Mantojuma tiesības un mantošanas lietu vešana ir sarežģīta, bet neatņemama sastāvdaļa jebkuras sabiedrības eksistencei. Tās prasa augstu juridisko kompetenci, ir sociāli ļoti nozīmīgas, jo potenciāli to realizācija skar katru Latvijas iedzīvotāju. Mantojuma lietu kārtošana iekļauj daudzus specifiskus juridiskus jautājumus, kas prasa kvalificēta jurista zināšanas un atbilstošu darba pieredzi. Kā viens no specifiskiem mantošanas tiesību jautājumiem ir bezmantinieka mantas institūts. Mūsdienās bieži vien rodas situācijas, kurās mantojuma atstājējam nav palicis neviens mantinieks vai arī mantinieks par mantojumu neinteresējas. Manta, kas paliek pēc personas nāves un kuru mantinieki ir atraidījuši atzīstama par bezmantinieka mantu un likumā noteiktajā kārtībā ir piekritīga valstij. Maģistra darbs „Bezmantinieku mantas tiesiskais regulējums” sniedz ieskatu bezmantinieku mantas institūta vēsturiskajā attīstībā, aplūkojot bezmantinieka mantas rašanās priekšnoteikumus līdz akta par mantojuma lietas izbeigšanu izdošanai un bezmantinieka mantas izsoles rīkošanai. Darba ietvaros analizēta arī tiesu izpildītāja rīcība ar bezmantinieka mantu saņemot notāra sagatavotu aktu par mantojuma lietas izbeigšanu. Pētījuma rezultātā autore izzina problēmjautājumus, kas skar bezmantinieku mantas tiesisko regulējumu, izsakot priekšlikumus attiecīgo problēmsituāciju risināšanai vai uzlabošanai.

Law of succession and dealing with the matters of succession are complicated, however they are an integral part of the existence of any society. They require high legal competence and they are of great social importance, because they potentially affect every resident of Latvia. Settling of succession matters includes many specific legal issues requiring proficiency of a qualified lawyer and relevant work experience. A specific issue of succession law is escheat institution. Nowadays there are frequent situations when the testator has no heir left or the heir is not interested in the inheritance. Property left after the person’s death and disclaimed by the heirs is considered to be an escheat and it becomes the competence of the state according to the procedure stated by the law. Master thesis “Legal regulation of the escheat” gives an insight into historical development of escheat institution, identifying the conditions of origination of the escheat till the issuing of statement on the dismissal of succession case and the organizing of escheat auction. Within the framework of the present thesis there has been analysed also bailiff’s activity with the escheat when the notary’s statement on the dismissal of succession case has been received. In the present research the author studies the issues connected with the legal regulation of the escheat and makes proposals for solving or improving the relevant problem situations.
