Tirgus dalībnieku apvienošanās ir izplatīta parādība komerciālajā vidē. Tomēr to potenciāla dēļ negatīvi ietekmēt konkurenci un attiecīgi kaitēt sabiedrības interesēm tiek veikta apvienošanos kontrole, lai lemtu par to atļaušanu vai aizliegšanu. Latvijā šo kontroli veic Konkurences padome. Tajā pašā laikā pastāv tikai vispārīga izpratne, pēc kādiem kritērijiem Konkurences padome veic apvienošanās ietekmes novērtēšanu. Tomēr tās kvalitatīva izpratne ir nozīmīga apvienošanās dalībnieku tiesību aizsardzībai un ne tikai. Ņemot vērā iepriekš minēto, maģistra darbs ir veltīts biežāk sastopamo horizontālo apvienošanos novērtēšanas kritēriju padziļinātākai izpratnei Konkurences padomes praksē, vērtējot Konkurences likuma aizliegto apvienošanos pamatpazīmju izpratni, Konkurences padomes izmantotos tiesību avotus un vērtējot Konkurences padomes un tiesu praksi pret konkurenci vērstas ietekmes izvērtēšanā, kā arī citus būtiskus ar to saistītus apstākļus. Maģistra darba izstrādes laikā izdarīti vairāki secinājumi saistībā ar dažādu metožu izmantošanu apvienošanos novērtēšanā, izmantoto kritēriju kvalifikāciju un galvenajām Konkurences prakses iezīmēm šo kritēriju izmantošanā. Mergers between different undertakings are common phenomenon in commercial environment. However it also has a negative potential to effect the competition in the relevant market thus also negatively affecting the public interest. Because of this mergers are controlled by the competition authority. In Latvia this institution is Competition Council (Konkurences Padome). In the same time there is only general understanding about the criteria used by the Competition Council to assess mergers regarding their effect on the competition. Taking into account mentioned above, this master thesis addresses deepened understanding on criteria for the assessment of horizontal mergers used by the Competition Council in its praxis. This includes the analysis of Competition Act (Konkurences likums) in respect to its regulation on prohibited mergers, legal sources used, assessment of anti-competitive effects in Competition Council’s praxis as well as other essential circumstances associated with the issue. In the end of the thesis the author has come to several conclusions regarding various methods used in the assessment of mergers, the qualification of the criteria used and main features in assessment of anti-competitive effects in Competition Council’s praxis.
