Tulkošana un autortiesības

Abstract

Pētījumā aplūkota saikne starp autortiesībām un tulkošanu. Autors noskaidro, kāpēc un pēc kādiem kritērijiem tulkojumiem pienākas autortiesību aizsardzība, vai visiem tulkojumiem pienākas vienāda aizsardzība un vai LR Autortiesību likuma tiesiskais regulējums atbilst mūsdienu praksei tulkošanas industrijā. Tiek aplūkota prakse citās ES valstīs, un tiek ņemtas vērā arī tulkojumzinātnes atziņas. Īpaša uzmanība veltīta jautājumam par tulkojumu oriģinalitāti un moderno tehnoloģiju ietekmi uz atsevišķiem autortiesību aspektiem. Pētījuma rezultātā tiek sniegti ierosinājumi likuma grozījumiem.

The paper looks at the links between translation and copyright. The author searches to establish why and based on what criteria translations should be protected by copyright; whether all translations should be protected equally; and whether protection offered by Latvia's Copyright Law can be considered adequate in today's translation industry. Practices that exist in other EU Member States are considered, and insights from translation science are also taken into account. Special attention is devoted to the issue of originality of translations and to the impact of modern technologies on certain copyright aspects. Certain amendments to the existing legislation are proposed.
