Mantojuma pieņemšanas forma.

Abstract

. Mantojuma pieņemšanas forma ir sarežģīts jautājums jau kopš Civillikuma sākotnes. Tomēr mantojuma pieņemšana ir svarīgs priekšnoteikums, kas jāievēro, lai mantinieks varētu iegūt mantojumu. Bakalaura darbs sniedz ieskatu mantojuma pieņemšanas formas veidos Latvijā un mēģina sniegt, konstatēto problēmjautājumu risinājumus, tai skaitā mantojuma pieņemšanas vietniecības jautājumā. Darbā salīdzināts Latvijas regulējums ar citu valstu mantošanas tiesību regulējumiem, veikts vēsturiskais atskats un sistēmiskā izpēte, pētīti prakses materiāli un aktualitātes mantojuma pieņemšanas institūtā attiecībā uz tās formu.

. Form of acceptance of an inheritance is complicated issue from the beginning of Civil Law. Nevertheless the acceptance of inheritance is momentous prerequisite, which has to be considered before obtaining heritage. This Bachelor gives an insight of forms of the acceptance in Latvia and tries to offer solutions of identified issues, including form of the accpetance of inheritance by representative. In this paper, regulation of Latvia is compared with other regulations of other countries, done historical review and systemic research, studied judicial practice and current events in legal branch of the acceptance of inheritance.
