Maģistra darbā identificēti un analizēti problēmjautājumi, kas saistīti ar morālā kaitējuma kompensācijas apmēra noteikšanu, akcentējot kaitējumu veselības aizskāruma gadījumā. Tāpat sniegts ieskats morālā kaitējuma jēdzienā un normatīvajā regulējumā, ar ārvalstu regulējumu salīdzināts tas subjektu loks, kam ir tiesības saņemt kompensāciju, un apskatīti kritēriji morālā kaitējuma kompensācijas apmēra noteikšanai. Darbā sniegta plaša ārvalstu literatūras piemēru analīze, apskatīta Latvijas tiesu prakse, kā arī aktuālie tiesu prakses apkopojumi attiecībā uz morālo kaitējumu. Secināts, ka Latvijas tiesu praksē, nosakot kompensāciju par morālo kaitējumu, būtiska nozīme ir vienlīdzības principam, taču, analizējot jaunāko tiesu praksi, noskaidrots, ka tas ne vienmēr tiek ievērots. Autors piedāvājis arī risinājumus morālā kaitējuma normatīvā regulējuma modernizācijai. The master's thesis identifies and analyzes issues related to determination of the amount of compensation for non-pecuniary damages, emphasizing damage to health. As well as gives insight into the concept of non-pecuniary damages and its regulatory framework, comparing the range of subjects, who are entitled to compensation with foreign law regulation, and discusses the criteria for determination of compensation for moral damages. Thesis provides extensive foreign literature case studies, accessed Latvian court practice and case law compilations in respect of non-pecuniary damage. Thesis concludes that in Latvian court practice, in the determination of the amount of compensation for non-pecuniary damages, the principle of equality is essential, but the recent case-law shows that it is not always respected. Author also offers solutions for modernization of the legal framework of non-pecuniary damage.
