Lai veicinātu sabiedrības uzticēšanos tiesu varai un nodrošinātu tiesisko noteiktību, nepieciešams uzlabot tiesas spriešanas kvalitāti. Kvalitatīvs apelācijas instances tiesas nolēmums var samazināt kopējo lietas izskatīšanas ilgumu un nodrošināt iespēju ātrāk sasniegt kriminālprocesuālo attiecību taisnīgu noregulējumu. Apelācijas instances tiesas kompetence jauna sprieduma taisīšanā ir atkarīga no pirmās instances tiesas nolēmumā konstatēto pārkāpumu rakstura un būtiskuma. Kādas ir apelācijas instances tiesas kompetences jauna sprieduma taisīšanā identificēšanas kļūdas un kā tās ietekmē nolēmuma tiesiskumu? Vai apelācijas instances tiesas tiesneši pareizi piemēro Kriminālprocesa likuma normas, taisot jaunu spriedumu? Vai Kriminālprocesa likumā ietvertais regulējums ir skaidrs un nodrošina vienotu izpratni? Darbā autore nonākusi pie secinājumiem, kuri sniegs atbildes uz minētajiem jautājumiem. In order to promote public confidence in the judicial power and to provide legal certainty, it is necessary to improve the quality of adjudication. Qualitative decisions from Court of Appeals may reduce the overall length of judicial proceedings and provide the opportunity to achieve a fair settlement of criminal legal relations faster. The Competence of a Court of Appeals in the Rendering of a New Judgment depends on the nature and the materiality of violations in the Judgment of the Court of First Instance. What are the mistakes of identifying competence of Rendering of a New Judgment in the Court of Appeals and how they affect legality of a Judgment? Or do judges of the Court of Appeal correctly apply the Criminal Procedure law, rendering a new judgment? Are the provisions of Criminal Procedure law clear and provide common understanding? The author has come to the conclusions that will provide answers to these questions in this thesis.
