Pašvaldības pienākums nodrošināt transportu izglītības pieejamības kontekstā

Abstract

Bakalaura darba mērķis ir atklāt pašvaldībai noteiktā pienākuma nodrošināt transportu izglītojamajiem, ja nav iespējams izmantot sabiedrisko transportu, saturu un apzināt tā izpildes problemātiku un īpatnības Latvijas novadu pašvaldībās. Lai sasniegtu bakalaura darba mērķi, analizēts tiesību uz izglītību saturs, apzināts pašvaldībai noteiktā pienākuma tvērums un padziļināti pētīta tā izpilde Latvijas novadu pašvaldībās, tai skaitā analizējot tiesu praksi. Galvenokārt secināts, ka novadu pašvaldību rīcības brīvībā konstatējami trīs modeļi: izdevumu kompensācija, netieša iesaiste skolas autobusu nodrošināšanā, pašvaldības transporta vai izglītojamo pašpārvadājumu organizēšana. Personai vispārējā gadījumā ir subjektīvās tiesības prasīt veikt pašvaldības faktisko rīcību – nodrošināt transportu, – izpildoties zināmiem nosacījumiem.

The aim of this bachelor’s thesis is to discover the content and identify the execution problems and peculiarities in local governments of municipalities of the obligation of local government to ensure transport for educatees to commute to the educational institution and back to their place of residence if it is not possible to use public transport. In order to achieve the aim of this thesis, analysis of the content of the right to education and identification of the scope of the obligation of local government was made, as well as deep research of the forementioned obligation in Latvian governments of municipalities, including analysis of case law. It was mainly concluded that there are three models of the discretion of local governments of municipalities: compensation of expenses, indirect involvement in provision of school buses, organization of local government transport or educatees own-account transport. In general, a person has the right to require the local government to perform an actual action – provide transport, – if certain conditions are met.
