Tiesnešu ētikas ievērošanas priekšnoteikumi Latvijas Republikas tiesību sistēmā

Abstract

Sabiedrības uzticība tiesu varai Latvijas Republikā nav ievērojami uzlabojusies pēdējo 10 gadu laikā. Lai stimulētu sabiedrības uzticību tiesu varai, ir nepieciešams stiprināt godīga jurista - tiesneša lomu sabiedrībā. Šī bakalaura darba galvenais mērķis ir noskaidrot, kā stiprināt sabiedrības ticību tiesu varai, apskatot tiesnešu ētikas galveno problemātiku. Darbā autore pēta ētikas regulējumus tiesnešiem Latvijā, atlases noteikumu trūkumus, tālākizglītības iespējas tiesnešiem un disciplinārsodu efektivitāti, apkopojot dažādus datus pēdējo 10 gadu laikā, lai noskaidrotu, vai ir nepieciešamas izmaiņas esošajos procesos tiesneša profesionālās darbības laikā. Autore norāda uz nepieciešamību paplašināt tiesnešu kompetenci noteikt tiesnešu algas apjomus, paaugstināt tiesnešu tālākizglītības kursu apmeklētību un tiesnešu disciplinārsodu atšķirības un piemērošanas nosacījumus.

Society’s trust over the Judiciary system on the Republic of Latvia has not improved on the past ten years. In order to stimulate society’s trust over the judiciary system, it is necessary to strengthen judge’s role in the society. The aim of this bachelors’ thesis is to established recommendations in order to strengthen society’s trust on the judiciary system, analysing within, the principal problems of ethics on judges. Herein, the author explores the ethical regulations of judges in Latvia, the disadvantages of the selection process of new judges, opportunities of continuing education, and effectiveness of a disciplinary sanction for violators. In accordance, it has been analysed data for over the past ten years to evidence the need of changes to the existing processes of judge’s professional development. The author has pointed out the need to extend judge’s power to determine their own salaries, stimulate attendance to Judge’s continuing education courses, and the understanding of the different disciplinary assumptions and sanctions to applied for each ethical offence.
