Kriminālprocesa likuma 127.panta trešā daļa nosaka, ka operatīvās ziņas var izmantot pierādīšanā kriminālprocesā, ja šīs ziņas var pārbaudīt likumā paredzētajā kārtībā. Praksē operatīvo ziņu izmantošana kriminālprocesā ir problemātiska, ņemot vēra operatīvās darbības pasākumu slepeno raksturu. Daudzi nozares praktiķi arī norāda, ka operatīvās ziņas nevar izmantot pierādīšanā, jo tas neizriet no operatīvās darbības mērķa un uzdevuma. Līdz ar to šajā jautājumā pastāv vairākas problēmas. Darbā tiek analizēts vai tiek sasniegts kriminālprocesa mērķis, ja tajā tiek izmantotas operatīvās ziņas kā pierādījumus, kā arī autors piedāvā noteikt ierobežojumus operatīvās darbības pasākumu veikšanas iespējām kriminālprocesā. Darbā arī tiek apskatīt ārvalstu regulējums šajā jautājumā. The third Paragraph of the Section 127 of the Latvia Criminal Procedure Law determines that the information resulting from the operational search activities can be used as evidence in the criminal procedure only if it is possible to examine such information on accordance with the procedures specified of the law. In practice the use of the information resulting from operational search activities in the criminal proceedings is problematic due to the confidential character of the operational search activities. Many field practitioners also point out that the information resulting from operational search activities can’t be used as evidence because it does not result from the purpose and the task of the operational search activities. Consequently the question contains several problems. The thesis provides the analysis whether the aim of the criminal procedure has been achieved by using the information resulting from operational search activities as evidence; the author of the thesis suggests determining the limits of the options for the operational search activities in the criminal procedure. The thesis also treats the foreign legal framework for this particular question.
