. Savu daļu iegādes finansēšanas aizliegums ir nostiprināts Komerclikuma 241.pantā un ir attiecināms uz akciju sabiedrībām, ne sabiedrībām ar ierobežotu atbildību. Finansēšanas aizliegums ir pārņemts no Padomes Otrās direktīvas, kuras grozījumi attiecībā uz finansēšanas aizlieguma “mīkstināšanu”, šobrīd nav pārņemti Latvijas nacionālajās tiesību normās. Darba mērķis ir analizēt būtiskākos problēmjautājumus un nepieciešamību ieviest Padomes Otrās direktīvas grozījumus Komerclikumā. Lai izvairītos no finansēšanas aizlieguma attiecināmību uz Sabiedrībām ar ierobežotu atbildību, nepieciešams veikt grozījumus Komerclikumā, precizējot finansēšanas aizlieguma attiecināmību uz akciju sabiedrībām. . The prohibition on financing the acquisition of its shares is established in Section 241 of the Commercial Law and applies to joint-stock companies, not to companies with limited liability. The funding ban has been taken over from the Second Directive of the Council, whose amendments regarding the abatement of the funding prohibition have not yet been transposed into Latvian national law. The aim of the paper is to analyze the most important issues and the need to introduce amendments to the Second Law of the Council into the Commercial Law. In order to avoid the eligibility of the financing ban for Limited Liability Companies, amendments to the Commercial Law need to be made, specifying the eligibility of the financing prohibition for joint-stock companies.
