Mūsdienās strauji pieaug ne tikai starptautisku ģimeņu, bet arī ar tām saistītu strīdu skaits, līdz ar ko aktuāls ir jautājums par to, kuras valsts tiesā risināmi pārrobežu ģimenes strīdi vecāku atbildības lietās. Briseles IIbis regula ir ieviesusi piekritības normu visaptverošu sistēmu, taču būtiski ņemt vērā, ka katram no piekritības noteikumiem ir specifiskas tā piemērošanas nianses. Maģistra darba “Aktuālās problēmas jurisdikcijas noteikšanā vecāku atbildības lietās Eiropas Savienības ietvaros” mērķis ir izpētīt Briseles IIbis regulā noteiktos piekritības noteikumus, kā arī regulējumu saistībā ar jurisdikcijas nodošanu un paralēliem tiesas procesiem, īpašu uzmanību pievēršot regulas normu piemērošanas problēmām praksē. Lai sasniegtu izvirzīto mērķi, darba ietvaros izpētīta arī Briseles IIbis regulas izstrādes nepieciešamība un analizēts regulas piemērošanas tvērums. Darba rezultātā autore secina, ka galvenokārt Briseles IIbis regulas jurisdikcijas normu piemērošanas problēmas saistītas ar regulā ietverto jēdzienu interpretāciju, līdz ar ko to risinājumi atrodami Eiropas Savienības Tiesas praksē. Tāpat veicot pētījumu, autore nonākusi pie secinājuma, ka būtisks un līdz šim neatrisināts Briseles IIbis regulas jurisdikcijas noteikumu trūkums ir forum necessitatis noteikumu neesamība. Nowadays is rapidly growing not only the number of international families, but also disagreements related to this matter, therefore in which country’s court cross-border family disagreements about the issues of parental responsibility must be solved, is a very actual question. Brussels IIbis regulation has implemented the universal system of compliance rules, however, it is essential to take into account, that there are specific adaptation nuances to every regulation of jurisdiction. The aim of the master's paper “Current issues in the defining of jurisdiction for parental responsibility within the European Union” is to examine the rules of jurisdiction which are defined in the Brussels IIbis regulation, as well as the resolution of the transfer of jurisdiction and parallel proceedings, while paying particular attention to adaption problems of the regulation norms in case law. In order to achieve the objective, the research also explores development necessity of the Brussels IIbis regulation and analyzes the scope of its implementation. The author of the research concludes that the problems of adaption of the jurisdictional rules of the Brussels IIbis regulation are mainly related to the interpretation of the concepts contained in the regulation, so that their solutions can be found in the case law of the Court of Justice of the European Union. In the same study, the author came to the conclusion that the lack of rules forum necessitatis for jurisdictional rules in the Brussels IIbis regulation is a significant and still unresolved issue.
