Atbildību mīkstinošie apstākļi

Abstract

Maģistra darba temats ir „Atbildību mīkstinošie apstākļi.” Maģistra darba mērķis ir izpētīt atbildību mīkstinošo apstākļu teorētiskos aspektus un šo apstākļu piemērošanu praksē un ar to saistītās problēmas, kā arī izpētīt ārvalstīs pastāvošo regulējumu attiecībā uz atbildību mīkstinošajiem apstākļiem. Maģistra darbā tiek aplūkota atbildību mīkstinošo apstākļu vēsturiskā attīstība, teorētiskie aspekti, piemērošana praksē, kā arī atbildību mīkstinošo apstākļu nozīme soda mēra noteikšanā. Nobeigumā aplūkots atbildību mīkstinošo apstākļu regulējums citās valstīs.

The topic of the master’s thesis is “Mitigation circumstances”. The aim of the master’s thesis is to research theoretical aspects of the mitigating circumstances and to look at the application of those circumstances in practice and the problems that arise from it as well as to research the foreign regulation concerning mitigating circumstances. In order to research the aim a historical development of the mitigating circumstances, theoretical aspects, application of those circumstances in practice as well as the importance of mitigating circumstances in determination of the sanction were researched. In the conclusion foreign regulation concerning mitigating circumstances was reviewed.
