Sociālais dialogs un tā rezultātā noslēgtais darba koplīgums, ir aktuāls jautājums gan Latvijā, gan visā Eiropā, par ko liecina liels pētījumu skaits šajā jomā. Nesen – 2017.gadā tika pilnveidots Latvijas Republikas Darba likumā noteiktais regulējums attiecībā uz darba koplīgumiem un, it sevišķi ģenerālvienošanos, līdz ar to tas ir visnotaļ pamatots iemesls, lai veiktu šo grozījumu un darba koplīguma institūta sistemātisko izpēti. Autore maģistra darba ir izvirzījusi šādu pētījuma mērķi: ar normatīvo tiesību aktu palīdzību noskaidrot priekšnoteikumus darba koplīguma noslēgšanai, identificēt ar to saistītos problēmjautājumus, kā arī atrast atbildes uz tiem, izmantojot aktuālās juridiskās zinātnes atziņas un tiesu prakses materiālus. Pētījuma rezultātā izdarīti secinājumi par sociālā dialoga attīstības priekšnoteikumiem, ka arī tiek piedāvāti grozījumi Darba likumā. Tāpat darbā ir izpētīta sociālā dialoga būtība un likuma nepilnības, kuras tiek konstatētas, piemērojot darba koplīgumu regulējošās tiesību normas. Vienlaikus autore identificē iespējamos valsts atbalsta mehānismus darba koplīgumu popularizēšanai. Darbā īpaša uzmanība pievērsta sociālās partnerības attīstības nepieciešamībai. Secinājumu daļā autore izvirza ierosinājumus konstatēto problēmu risināšanai. As evidenced by the large number of studies, social dialogue, and its result - collective agreement, is topical issue in Latvia and throughout Europe. Recently, in 2017, labor law provisions of the Republic of Latvia regarding labor collective agreements, and in particular the general agreement, have been refined, what is a sufficient reason for the systemic study of these amendments and labor collective bargaining regulation. Author has set such aims of master’s research: find out preconditions for the conclusion of a collective agreement, identify related issues and find answers to them by means of regulatory enactments, using current judicial practice and doctrine. The research summarises the conclusions about preconditions of social dialogue development, amendments to the current labor law are suggested. Furthemore, study explore the essence of the social dialogue and the imperfections of the law, which are found out in the law application process. At the same time, the author identifies possible state support mechanisms for the promotion of collective agreements. The main focus of the study is need for social partnership development. In conclusion, author makes suggestions in order to solve identified problems.
