Cesijas priekšmets

Abstract

Cesijas rezultātā notiek saistību tiesību pāreja no vienas personas otrai, tomēr ne visas saistības var cedēt, sakarā ar to, ka likumā skaidri nav noteikts kādas saistības var un kādas nevar būt par cesijas priekšmetu arī praksē nav viennozīmīgas skaidrības par cesijas priekšmetu. Bakalaura darbā ir pētīts cesijas priekšmeta jēdziens, veidi un ierobežojumi, kā arī šādu darījumu sekas. Pētījuma mērķis ir noskaidrot iespējamos cesijas priekšmetus, pētījums ir vērsts uz pašreizējā normatīvo aktu regulējuma izpētīšanu nevis tiesisko uzlabojumu ieteikumiem. Darba rezultātā autors nonāca pie dažādām atziņām par to, kādus prasījumus var cedēt un kādi ierobežojumi pastāv cesijai.

The result of an effective act of assignment is transfer of the right from the assignor to the assignee, however not every right can be transferred, due to fact that the Civil law of Latvia do not include perfect definition of scoupe of assignment in practice there aren’t clear which rights are assignable and which are not. In this undergraduate research scoupe of assignment meaning, types and restrictions and consequences are researched. Purpose is aimed to research actual regulation, not to advice improvements. As a result author got to several thesis about scoupe of assignment and restrictions of it.
